General Conditions of Purchase

The Web Site offers the service of on-line purchase, which means a 24h. service, simple, direct and with all the advantages of having a wide catalogue of products updated and available from any place through an Internet connection.

GENERAL

All prices are in Euros and in accordance with current legislation, all purchases made through the Website will be subject to Value Added Tax (VAT), and this amount is included in the price. The User will be able to see a breakdown of the amount of the product and VAT in the shopping cart before confirming the order.

Direct orders will be served from the on-line shop within the Spanish mainland, the Balearic Islands and countries of the European Union.

The Proprietor reserves the right to refuse an order from any User with whom it has a dispute or there have been problems in the payment of previous purchases.

OBLIGATIONS OF USERS

Any User who makes a purchase through this Website declares to be of legal age and, where appropriate, with full capacity to use means of payment and that they have sufficient funds to cover all costs resulting from the purchase of products, the User also declares to fully and unreservedly accept all the conditions of this Legal Notice.

The User may make one or more requests for the purchase of products or services offered through the Website.

DELIVERY CONDITIONS

All orders placed within mainland Spain are sent by courier through the company MAILBOXES.

Orders are not handled or delivered on weekends and holidays.

Shipping costs for mainland Spain and the Balearic Islands are 8 euros and for orders over 120 euros will be free. For EU countries, you can see the shipping costs in the following table.

Any additional shipping costs caused by the declaration of an incorrect or incomplete address are the sole responsibility of the User.

The most economical option for orders will always be to pick up at the warehouse, if the user wishes the order to be sent home this will be a freely chosen option and therefore will involve an additional cost in the purchase of products.

PAYMENT METHODS AND SECURITY

In compliance with Commission Delegated Regulation (EU) 2018/389 of 27 November 2017 supplementing Directive (EU) 2015/2366 of the European Parliament and of the Council of 25 November 2015 on payment services in the internal market, the User making an online payment transaction must do so by means of enhanced authentication. Depending on the chosen means of payment and the economic value, with the exceptions provided for in the Directive, the User will have to provide a second identification factor before placing an order, such as a PIN code that the User will receive on his/her mobile phone and that he/she will have to enter to validate his/her purchase.

According to the PSD2 Directive, strong authentication exists when at least two of the following elements are used for authentication:

Knowledge (something that only the User knows, e.g. password, PIN code, access data, etc.).
Possession (something that only the User has, e.g. a mobile phone where an SMS is sent to verify the transaction, email address, etc.)
Inherence (something that is inherent to the User, e.g. the possibility of biometric verification, either by fingerprint, facial recognition, etc.).
These elements are independent of each other. In other words, a breach of one does not compromise the reliability of the others, and the confidentiality of identification data is always protected.

For the convenience of the User, we provide different ways to make the payment:

1) Bank Transfer.

– Once the order has been placed, the bank details are provided to make the deposit or transfer for the amount of the purchase made, and the personal details of name, surname and identity document must be indicated. Only deposits in Euros will be accepted. The order will be processed once the amount has been received in the account.

– With this form of payment no commission is paid.

2) Credit card.

– This payment method is immediate, totally secure and verified by Redsys secure servers in the payment gateway. Under no circumstances will credit card details be disclosed.

– Accepted credit cards are: Visa, 4B, Maestro and Master Card.

– Only secured credit cards will be accepted to avoid any possible risk or fraud. Secured cards have security codes associated with them and, at the end of the payment process, the card is transferred to the bank’s payment gateway, where these codes must be entered. If you do not have a secured card for online payments, the bank must provide the necessary information and passwords.

3) PayPal

– Secure payment solution that allows buyers and businesses to send and receive money online. By selecting this method when finalising the order, the User will directly access the PayPal website. You do not need to enter bank details, you only need to have a PayPal account created and you can make payments by entering only your email and password, you can also create the account at the time or make the payment directly by entering the details of the credit card. The data entered on the PayPal website is not communicated.

RIGHT OF WITHDRAWAL

In compliance with Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of 16 November, information is provided on the User’s right of withdrawal.

5.1 When the User is a consumer and the contract is concluded without the simultaneous physical presence of the User and the Proprietor (distance selling), the User shall enjoy the right of withdrawal described in this section, with the exceptions provided for in article 103.

5.2 Information to the consumer and user on the right of withdrawal.

a) The User has the right to withdraw from this contract within 14 calendar days without giving any reason.
b) The withdrawal period shall expire after 14 calendar days from the day of conclusion of the contract.
c) To exercise the right of withdrawal, the User must notify us of his/her decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post or e-mail).
d) In order to comply with the withdrawal period, it is sufficient that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period.
e) In the event of withdrawal by the User, the Proprietor shall refund all payments received without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of the decision to withdraw from this contract. In the event that shipping costs have been incurred for any products, the Proprietor shall use the same means of payment used by the User for the initial transaction, unless the User has expressly provided otherwise and provided that the User does not incur any costs as a result of the reimbursement. In the event that the User has expressly selected a delivery method other than the least expensive ordinary delivery method, the Proprietor shall not be obliged to reimburse any additional costs arising therefrom.

5.4 According to Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of 16 November, in its art. 103, the right of withdrawal shall not apply to contracts relating to (among others):

(e) The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.
In relation to this section, with the User’s order, the User gives his prior express consent, with the knowledge and acceptance on his part of the exceptions contained herein, and consequently in these cases, he loses his right of withdrawal.

RETURNS

An order shall be considered delivered when the delivery receipt is signed by the User. The User will have a period of 14 calendar days to make any return.

You may return or exchange a product we recommend that it has not been used and that it is in its original packaging, with the labels in perfect condition. Otherwise, the User will be responsible for the diminished value of the products resulting from handling other than that necessary to establish their nature, characteristics or operation, as established in article 108 of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.

The Proprietor reserves the right to inspect the returned products before processing the return. No returns will be accepted for wines that have been partially or totally consumed.

To request a return, the User must contact by email at visita@bodegastradicion.com and provide the following information: order number, details of the products to be returned and reason for the return. Once the return is approved, instructions on how to send the products back will be provided.

Return Shipping Costs:

Return shipping costs will be borne by the User, unless the return is the result of an error on the part of the Proprietor or the products have arrived damaged.

Refunds:

Once the returned products are received and verified, the refund is processed within a reasonable time frame.

The refund will be made using the same payment method used in the original purchase, unless otherwise agreed with the User.

Damaged or Defective Products:

If the products arrive damaged or with a defect, the Proprietor must be notified immediately to resolve the situation. The latter may request photos or any documentation necessary to process the claim and provide an appropriate solution, such as replacement of the products or a full refund.

The shipping costs for returns will be borne by the User unless there has been any error in shipping by the Proprietor and the return will be made in exchange for another product to the User’s liking, if there is none at that time, the value economic will be saved in a balance in favor of the User for an indefinite period, to be able to use it in any other purchase.

AVAILABILITY

The Proprietor undertakes not to make available to Users an item that is not in stock unless there is a computer error or any other unforeseeable situation. In the event that this unfortunate incident could occur, the Proprietor undertakes to inform the User and reach a satisfactory agreement with them.

Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 establishes as an objective the achievement of a high level of consumer protection and the proper functioning of the internal market, in particular its digital dimension, providing a European online dispute resolution platform that facilitates the out-of-court resolution of disputes between consumers and online merchants in an independent, impartial, transparent, effective and equitable manner.
